A TRP ENABLES A PERSON TO OVERCOME THEIR INADMISSIBILITY
Those who are inadmissible to Canada may enter the country by obtaining a Temporary Resident Permit (TRP) issued by Immigration Canada. This is not the same as a Temporary Resident Visa (TRV). The first may be a status document, whereas the second may be a travel document. In spite of your inadmissibility, you will be able to enter and visit Canada with the Temporary Resident Permit, a travel document.
TRPs enable individuals to overcome their inadmissibility for a specified reason. Applicants must demonstrate a compelling reason for entering Canada. Individuals who are criminally inadmissible to Canada are inadmissible for work, study and visitation purposes and are not eligible to apply for Canadian permanent residence.
Qualifying for a Temporary Resident Permit
In addition to meeting Canada's social, humanitarian, and economic obligations, TRPs allow officers to respond to exceptional circumstances. In making the decision whether or not to issue a TRP, the officer will take into account the following factors:
- Inadmissible and seeking admission to Canada if the officer believes it is justified in the circumstances;
- Is inadmissible, subject to a report, a reportable violation of the Act, or otherwise does not meet the requirements of the Act;
- Is not eligible for restoration of status.
In general, successful TRP applicants will be individuals able to demonstrate that they do not pose a risk to Canada and that they will not burden its welfare system. It will be beneficial to a person's chances of success if they can demonstrate these qualities.
There is no guarantee that you will be granted a temporary residence permit. This is a temporary waiver of inadmissibility which allows an individual not otherwise eligible to enter Canada to do so. For a specific reason and for a specific period of time, up to a maximum of three years, this is granted.
